Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is incorporated by reference into, and governed by the agreement(s) by and between Big Idea Inc. (“Big Idea”, “we”, “us”, “our”) and you (“Agreements”) when you access and use our Platform. Defined terms with initial capital letters have the meaning as specified in the Agreements, unless defined in this AUP.
You agree that you will not, nor permit, authorize or allow any third party, to use the Platform to do any one or more of the following:

for any illegal or fraudulent activity;
to impersonate any person or entity, or falsely state of otherwise misrepresent you or your affiliation with us, our employees, another user, or any other person or entity;
to use our Platform in a manner that may create a conflict of interest or undermine the purposes of the Platform, such as trading reviews with other users or writing or soliciting fake reviews;
to provide us with any private information about or from any third party, including but not limited to, email addresses, personal information, unless authorized by the third party and in accordance with our policies;
to violate any laws, regulations, governmental orders, or industry standards or guidance in any applicable jurisdiction;
to violate the rights of others (whether confidentiality, privacy or otherwise);
to threaten, incite, promote, or actively encourage violence, terrorism, or other serious harm to another;
to include any content and/or documents that infringes or misappropriates the intellectual property rights of others;
to include any content and/or documents that is health or medical related and protected under the Health Insurance and Portability and Accountability Act (HIPAA);
to include any content and/or documents that includes debit card, credit card, banking information, financial account information, and code or password that could be used to gain access to financial information or similar information, since the Platform is non-compliant with Payment Card Industry Data Security Standards (PCI DSS), unless we authorize such User Content through our payment processor;
to include any content and/or documents that includes social security number, driver’s license number, other government-issued identification number, insurance identification number or account number, background check information, biometric data, digital signatures or personal data;
for materials or activities that are subject to the International Traffic in Arms Regulations maintained by the United States Department of State;
to access or use the Platform from a location where we are unable to provide the Platform due to export control laws, or economic or other sanction laws to which we are subject;
to include any content and/or documents that requires an export license, unless you have obtained the appropriate export licenses;
to include any content and/or documents, or engage in any activity that promotes child sexual exploitation or abuse;
to include any content and/or documents that is defamatory, obscene, pornographic, indecent, excessively profane, abusive, threatening, harassing, hateful (including attacking others based upon their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition, or is otherwise exploitive or abusive), or otherwise objectionable as determined by us, in our sole discretion;
to distribute, publish, send, or facilitate the sending of unsolicited or unauthorized mass email or other messages, promotions, advertising, pyramid schemes, contests, sweepstakes, or solicitations, junk mail, chain letters, or spam;
to send altered, deceptive, or false source-identifying information, including spoofing and phishing;
to incorporate malicious content (including but not limited to, code, files, scripts, agents or programs), such as malware, time bombs, trojan horses, worms, viruses, backdoors, drop dead devices, or similar harmful content that are intended to interfere with, restrict, impeded, disable, erase, or do harm to the Platform;
to download any content and/or documents made available on the Platform for the purposes other than your own personal use or the intent of use for such content and/or documents;
to delete or remove any other user’s content and/or documents, without the other user’s written consent (email acceptable);
to interfere with or in any way disrupt the Platform, tamper with, breach, or attempt to probe, scan, or test for vulnerabilities of our computer systems, network, usage rules, or any of our security components, authentication measures or any other protection measures applicable to the Platform or any part thereof;
to launch or facilitate, whether intentional or unintentional, a denial of service attack (including any actions, which effectively cause a similar result) on the Platform, or any other conduct that materially and adversely impacts the availability, reliability, or stability of the Platform; or
to use any robot, spider, offline readers, automated scripts, or other automatic systems or devices, process or means to access the Platform for any purpose, including monitoring or copying any of the material (including data mining, data harvesting, data extraction, scraping) on the Platform.

3. We reserve the right, but we do not assume the obligation, to investigate any violation of this AUP. If you violate any of the terms of this AUP, we may suspend or terminate your use of the Platform, and cancel your Account with us.

4. We may report any activity that we suspect violates any law or regulation to the appropriate law enforcement authorities, regulators, or other appropriate third parties. Our reporting may include disclosing any personal information, as well as network and system information, that is necessary for the investigation and prosecution of the violation, without any liability to us. We will have no obligation to notify you of such reports.

5. In the event that we (a) are contacted by any law enforcement authorities, regulators, or other appropriate third parties, or (b) receive a court order or subpoena for violation of any law or regulation, then we will cooperate fully and provide any personal information, as well as network and system information, that is requested or necessary for the investigation and prosecution of the violation, without any liability to us. We will have no obligation to notify you of such requests.

6. If you become aware of a violation of this AUP, you agree to immediately notify us and provide us with assistance in stopping the violation, as applicable. To report any violation of this AUP, please contact us at the email specified in section 8 below.

7. Occasionally, we may make changes to this AUP. and the most recent version of this AUP is the one that applies to you. If we make material changes to this AUP, we will provide you with notice by displaying a prominent notice on our website or our Platform or by sending you an email. Please make sure you read any such notice carefully. Having received notice of any changes to this AUP, if you continue to access and use the Platform, then you agree to the updated AUP. Neither the course of conduct between the parties nor trade usage will act to modify or alter the provisions of this AUP.
